Terms of Use

These Terms of Use (“Terms”) govern your use of the mobile applications and related services (collectively, the “Apps”) published by WildFox Tech LLP (“WildFox Tech”, “we”, “us” or “our”). By downloading or using any of our Apps, you agree to be bound by these Terms.

In addition to these Terms, your use of the Apps may also be governed by the terms and conditions of the app store or platform from which you downloaded the App (such as Apple’s Licensed Application End User License Agreement for iOS apps, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/ , and the Google Play Terms of Service for Android apps). Those store terms apply between you and the respective store provider; these Terms apply between you and WildFox Tech LLP.

1. Use of the Apps

You may use our Apps only for lawful purposes and in accordance with these Terms and any applicable store or platform rules. You are responsible for maintaining the security of your device and any accounts associated with the Apps.

2. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Apps on devices that you own or control, solely for your personal, non-commercial use, unless otherwise expressly permitted in the App.

3. In-app purchases and subscriptions

Some Apps may offer in-app purchases (such as premium content, additional features or subscriptions). Payments for such purchases are processed by the respective app store (Apple App Store, Google Play or other authorised store) under their own terms and policies.

Please review the subscription conditions, renewal terms, free trial periods and cancellation instructions in the store interface before making a purchase. We do not handle payment details directly and cannot access your credit card or other billing information.

4. User content

If an App allows you to create, upload or share content, you are responsible for that content and must ensure that it does not infringe any third-party rights or violate applicable laws. You grant WildFox Tech a non-exclusive, worldwide, royalty-free license to use such content solely for the purpose of operating and improving the Apps.

5. Intellectual property

All rights, title and interest in and to the Apps, including their code, design, text, graphics, trademarks and other content, are owned by WildFox Tech LLP or its licensors and are protected by applicable intellectual property laws. Except for the limited license granted above, no rights are transferred to you.

6. Prohibited activities

You agree not to:

• reverse engineer, decompile or attempt to extract the source code of the Apps, except where permitted by law;
• circumvent or interfere with security features or technical protections;
• use the Apps for any unlawful, harmful or abusive purpose;
• modify, distribute, sell, resell or lease the Apps or any part of them without our prior written consent.

7. Disclaimer of warranties

The Apps are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose and non-infringement.

8. Limitation of liability

To the maximum extent permitted by law, WildFox Tech LLP and its partners shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, revenue or profits, arising out of or in connection with your use of the Apps.

9. Termination

We may suspend or terminate your access to an App at any time if you violate these Terms or if we decide to discontinue the App. You may stop using the Apps and remove them from your devices at any time.

10. Third-party links and services

Our Apps may contain links to third-party websites or integrate third-party services. We are not responsible for the content, policies or practices of those third parties. Your use of third-party services is subject to their own terms and conditions.

11. Changes to the Apps and these Terms

We may update or modify the Apps (including adding or removing features) and these Terms from time to time. When we make material changes, we may provide notice within the Apps or through the app store. Your continued use of the Apps after changes have been published constitutes your acceptance of the updated Terms.

12. Governing law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Local mandatory consumer protection laws may also apply.
